Since July 1988, when The Real Estate Act became law, the Saskatchewan Real Estate Commission has been responsible for the regulation of the real estate industry in this province. This includes the investigation of complaints against real estate registrants. For more information, please research our website.
How long will it take for my complaint to get resolved? Will you keep me informed of any progress?
The time taken to investigate a complaint depends on the workload of the Commission’s Review Officers and on how complex your case is. It will usually take several months. No information on the progress of the investigation can be provided as this might jeopardize the objectivity of the investigator. According to The Real Estate Act, you will be advised of the decisions of the Investigation Committee and of the Hearing Panel as they occur.
Will you get me my money back, and/or provide for my damages? Can I cancel the deal?
The Saskatchewan Real Estate Commission’s investigations and sanctions deal only with the conduct of the industry member involved. The return of deposits or other funds and issues regarding contracts are left to the Courts.
All industry members are doing it, why are you picking on me? Don't you have more serious things to investigate?
The Real Estate Act requires that all written complaints be investigated, including those that may seem frivolous at first glance.
Will I have to be a witness?
Both the complainant and the industry member will be interviewed during the investigation. If the matter goes to a hearing or prosecution, the complainant may be asked to testify.
Can the information I give you be used in court?
The Real Estate Act states that information on an industry member that is gathered by an investigator cannot be used in a prosecution under other laws or in a civil law suit.
The local real estate board has already investigated this. Why are you doing it too?
In some cases, the local real estate board and the Commission receive the same complaint. This can lead to two investigations that may have different purposes. The board looks into the industry member's right to membership in the board, while the Commission investigates the industry member's ability to trade in real estate in Saskatchewan.
Can I withdraw my complaint? If I settle with the complainant, will you stop the investigation?
